The Joint Admissions and Matriculation Board’s (JAMB) regulation establishing 16 as the minimum age for university entrance has been declared unlawful by Delta State High Court 2 in Warri.
On Thursday, February 27, 2025, Hon. Justice Anthony O. Akpovi delivered judgement in Suit No: W/311/FHR/2024, upholding John Aikpokpo-Martins’ claims, with the exception of his demand for monetary damages.

The public interest case was launched by Aikpokpo-Martins, a former chairman of the Nigerian Bar Association (NBA), Warri branch, who claimed that JAMB’s age restriction was unconstitutional under sections 18(1) and 42 of the 1999 Constitution.
He requested a number of declarations, such as:
- That younger applicants are discriminated against and their constitutional right to equal educational opportunity is violated by the 16-year-old minimum age requirement for university entrance.
