After experiencing bullying from her peers, Namtira Bwala, a student at Lead British International School in Abuja, filed a lawsuit against the institution.
Bwala claims that because the school did not fulfill its obligation to create a secure and encouraging learning environment, other students mistreated her.
Bwala, through her legal representative Marvin Omorogbe of Deji Adeyanju and Partners, has filed a civil claim at the Federal Capital Territory High Court located in Abuja.
Her requests include ₦500 million in general damages compensation and a public apology printed in two national newspapers.
The legal move follows an earlier warning from the Adeyanju chamber, which threatened to take legal action against the school for failing to take adequate action against the student who was harassing Namitira.
Bwala recently gave a statement to Pulse in which she asked for the school to be recognized for its duty of care to its students and holds them responsible for their failure to stop her assault and emotional suffering. She wants compensation for the stress and invasion of privacy she had while being watched over by the school.
According to her most recent statement, “A declaration that the defendant owes the claimant a duty of care to protect her from any physical or emotional harm as well as any breach of her privacy while under the defendant’s custody and supervision,” because the claimant is a student at Lead British International School in Gwarimpa, Abuja.
“A finding that the defendant engaged in negligent behavior by failing to stop the claimant’s abuse, suffering, mental anguish, agony, and trauma while the claimant was under the defendant’s care and supervision.
An order directing the defendant to pay the claimant N500,000,000.00 (five hundred million naira) in general damages for the defendant’s negligence in failing to prevent the claimant’s assault, torment, emotional distress, pain, trauma, and invasion of privacy while the claimant was in the defendant’s care and supervision, as well as for the defendant’s breach of the duty of care it owed to the claimant.
The complaint was sparked by a widely shared video that showed Bwala being physically assaulted by Maryam Hassan, a classmate. In the video, Bwala is shown being slapped and tortured while being questioned about her emotional discomfort.
